Tôi làm việc tại cty A, có ký HĐ đào tạo 2 năm, nhưng tôi làm chưa hết HĐ ( làm được 1.5 năm) , Tôi tự ý thôi việc và đã làm việc tại cty khác . Tôi muốn đóng tiếp vào sổ BHXH cũ nhưng cty A không đồng ý cho tôi nhận lại sổ BHXH với lý do là tôi nghỉ ngang . Cho Tôi hỏi cty không trả lại sổ cho người lđ là đúng hay k? tôi nên làm gì để nhận lại sổ BHXH ( cty A yêu cầu tôi phải bồi thường hợp động đào tạo , nhưng tôi không có khả năng chi trả )

 Trong trường hợp này thì DN không có lý do gì mà không trả sổ cho NLĐ khi đó NLĐ có thể kiện công ty ra tòa án.
Song trong trường hợp này bạn cần lưu ý DN có thể kiện bạn vì vi phạm hợp đồng.
